Terms and Conditions

Please read the following Terms and Conditions carefully. You will be required to sign the declaration on your enrolment, which means you are accepting these terms and conditions.

Enrolment Terms and Conditions for Fee-Paying students

Fees

Confirmation of enrolment will be provided in the form of an invoice.  If you are paying your fees privately, i.e. not through a student loan, payment is due within 14 days of the date of the invoice and NO LATER than the start date of the courses enrolled.  If you are applying for a student loan through StudyLink, we expect you to complete your application as soon as possible and NO LATER than the start date.  Any student who wishes to dispute the fees due must do so within seven (7) working days of receiving the invoice.  A request to review the fees or account balance must be made within this period, in writing to the Director of Domestic Operations, Ashton Warner Academy.  At the discretion of Ashton Warner Academy, and with just cause, this period may be extended.  Once the request is received, the review will be completed within seven (7) working days.  Once the review is completed, any outstanding balance is due immediately.  Failure to pay any invoice(s) by the due date means you will then be liable for all costs and expenses (including legal costs, debt collection agent fees, and this may affect your credit rating) which may be incurred in the recovery or attempted recovery of the overdue amount from you.  Under these circumstances Ashton Warner Academy may give to, or obtain from, any relevant third party, information held about your personal or commercial credit arrangements.  Academic results for a student will be withheld for any programme where fees or any other debt remains unpaid.  A student will be prevented from graduating or receiving their award(s) until their debt has been paid in full.  The student will also be prevented from re-enrolling in further courses of study.

Transfers

Transfers are negotiated with the Academic Director.  There are no penalties; however, there may be additional fees required or a refund may be due.  Where a student loan has been used to pay fees, the refund will need to be returned to StudyLink and a new loan drawn down for the new programme.

Withdrawals and/or refunds

Make sure you understand the refund policy before enrolling. If you want to leave your programme you must formally withdraw by notifying Ashton Warner Academy via studentsuccess@nannyacademy.ac.nz. Withdrawal is confirmed from the date the email is received by Ashton Warner Academy and this email will be used when processing your withdrawal in the database and determining the amount of refund.

Compassionate consideration

If you withdraw after 10% of the length of course enrolment, you may be eligible for a refund under compassionate consideration.  Compassionate consideration may be considered for the following reasons:

– Medical, supported in writing by a health professional
– Work-related, supported by a letter from an employer
– Student Services will advise the result of the application for compassionate consideration.

Non-attendance

If you have more than three consecutive weeks of non-attendance in classes, or non-participation in required online activities associated with your programme, and we are unable to contact you, you will be withdrawn from the programme.

Privacy or Personal Information

Ashton Warner Academy collects and stores information about students to comply with various statutes and/or regulations, to enable us to make decisions regarding your academic progress, and to provide you with evidence of your academic achievements. This information may be also shared with relevant departments at Ashton Warner Academy on a “need to know” basis, and is used to arrange appropriate support for students. After graduation your contact information is used for the graduate progression survey.

Where it is relevant, personal information may be disclosed to other agencies such as, but not limited to: the Ministry of Education, Audit New Zealand, New Zealand Qualifications Authority, Industry Training Organisations, industry licensing and registration bodies, other tertiary institutions and providers of work experience for students in courses with a practical component.

Students have the right to request to see and correct if necessary the information you have provided. If you wish to enquire about personal information held by Ashton Warner Academy please contact Student Services.

Public Trust

As part of the enrolment process you will receive a Public Trust Fee Protection Contract. By law, private training establishments registered with the New Zealand Qualifications Authority (NZQA) are required to have some form of protection for fees paid to them in advance. Ashton Warner Academy has chosen

Public Trust – Fee Protect.

Fee Protect is a student fee trust account which ensures you receive a refund on student fees, which are held in trust, if in the unlikely event Ashton Warner Academy is unable to complete your programme of study. This could be because of closure, insolvency, loss of NZQA accreditation or programme within the stated timeframe.

You are required to initial, sign and return the Public Trust Contract to Ashton Warner Academy within seven days of its receipt. You will find more information about Public Trust – Fee Protect here.

 

Cancellation

Enrolment in a programme is conditional upon and subject to sufficient numbers of students enrolling in the programme.

 

Privacy (Personal Information)

Ashton Warner Academy collects and stores information about students to comply with various statutes and/or regulations, to enable us to make decisions regarding your academic progress, and to provide you with evidence of your academic achievements to

  • manage the business of Ashton Warner Academy (including internal reporting, administrative processes and selection of scholarship and prize winners).
  • comply with the requirements of the Education Act 1989 and other legislations relating to maintenance of records.
  • supply information to government agencies and other organisations as set out below.

In signing the enrolment form you authorise such disclosure on the understanding that Ashton Warner Academy will observe the conditions governing the release of information, as set out in the Privacy Act 1993, the Education Act 1989 and other relevant legislation.

NB: The Privacy Act came into force on 1 July 1993 with the stated aim of protecting the privacy of natural persons. It requires Ashton Warner Academy to collect, hold, handle, use and disclose personal information in accordance with the twelve information privacy principals in the Act. http://www.privacy.org.nz/privacy-act.

Supply of information to government agencies and other organisations

Ashton Warner Academy supplies data collected from you to government agencies, including:

  • the Ministry of  Education.
  • the New Zealand Qualifications Authority.
  • the Tertiary Education Commission.
  • the Ministry of Social Development (in relation to student loans and allowances) and Inland Revenue (student loans).
  • agencies who support particular students through scholarships, payment of fees or other awards (if you are a recipient of one of these awards).

These agencies use the data collected from tertiary education organisations to:

  • administer the tertiary education system, including allocating funding.
  • develop policy advice for government.
  • conduct statistical analysis and research.

Your  personal details (name, date of birth and residency) as entered on the form will be included in the National Student Index and may be used in an authorised information matching programme with the New Zealand Birth Register.

The government agencies above may supply data collected on the form to Statistics New Zealand for the purposes of integrating data with data collected by other government agencies, subject to the provisions of the Statistics Act 1975. Integrated data is used for the production of official statistics, to inform policy advice to government and for research purposes. In handling data supplied by you on this form, the government agencies are required to comply with the provisions of the Privacy Act 1993.

When required by law, Ashton Warner Academy releases information to government agencies such as the New Zealand Police, Department of Justice, Ministry of Social Development, and the Accident Compensation Corporation  (ACC). Information collected from you may be supplied to other educational organisations for the purpose of verifying academic records.

You may see any information held about you and amend any error in the information. To do so, please contact student services team.

 

Course Attendance

You must attend classes consistently and come to class on time. Your class timetable will be given to you at orientation. If you are unable to attend class, or if you will be late to class, you must advise your lecturer or student services  prior to 9am. If you need to finish class early, you must advise your lecturer in advance. If you are consistently late or leaving early, or are absent without a valid reason or prior approval, you will be given a warning.

Behaviour

Be respectful of others

We expect Ashton Warner Academy students and staff to

  • Respect student and staff rights to study and work in a safe, tolerant and favourable environment
  • Respect others’ culture, religion, personal preferences and social customs
  • Treat others and speak to others with respect.

No violence – Physical Or Verbal Or Bullying. No Cyber Bullying

Violence, harassment or bullying of any person on or off campus is unacceptable.

Harassment and bullying includes:

  • Offensive sexual or racial jokes or abusive language about someone;
  • Offensive gestures or comments;
  • Unwanted and deliberate physical contact;
  • Unwanted and threatening cyber contact including on Facebook, email or text messaging
  • Requests for sex or sexual contact, which include a threat or an implied or overt promise for preferential treatment.

You must not use any foul, obscene or abusive language.

No Weapons

You are not allowed to bring any weapon on to the campus.

Smoking

You must not smoke on campus except in designated areas.

No drugs or alcohol

You must not use, be under the influence or bring alcohol, non prescription drugs, stimulants or other chemicals while on campus.

Careful use of equipment and resources

You are expected to use equipment and resources with care.  You will be responsible for any damage caused by misuse or abuse and will be required to pay for any damage you cause.  Your Lecturer’s permission must be obtained for the use of equipment outside normal class hours and during breaks.

Earl Richardson campus area

Ashton Warner Academy shares driveway access with other organisations, therefore we request that students respect this shared space.  Students are therefore not to congregate or play with balls of any sort in the driveway areas.  Students are requested to use the footpath when walking to and from class, and to lunch bars in the area. We expect all students to show consideration and respect to other organisations in the area.

Personal Property

Ashton Warner Academy does not accept responsibility for any loss or damage to students’ personal property.  We recommend that you do not bring valuables to the campus.  You must not deliberately damage or take without permission any property belonging to another student or staff member.

Dress code

You must wear clothes and footwear suitable for the training you are doing.

Workshop safety

There are safety rules and procedures which must be followed at all times in the trade workshops or during field trips.  You must follow all safety instructions and abide by the safety rules.

 

Contact Details

You must provide Student Services with your current address and contact phone numbers. If you change your address or your phone number, you must immediately advise Student Services.

 

Computer, Mobile and Internet Usage

  • Computers provided by Ashton Warner Academy are for use by all students.
  • Students are reminded that no student can expect exclusive use of any one computer.
  • You are not allowed to view or download pornographic images on the computers owned by Ashton Warner Academy.
  • Any student who uses email or texting to harass, intimidate or abuse another student, staff member or member of the public may face immediate dismissal.
  • You are responsible for the protection of your password.  This means not giving your password to any other student.
  •  You must not load or download any programmes on to a computer without the permission of your lecturer.
  •  You must not download, copy or use any offensive images or images depicting drugs, or violence.
  •  You must not store any MP3 or video files without the permission of your lecturer.
  • Please turn off your mobile phones during class unless agreed with by your lecturer.

 

Complaints

If you wish to make a complaint, you should first talk to your Lecturer about your concern especially if it is concerning assessment results, course delivery or any student behaviour that concerns you, for example bullying. If you feel uncomfortable talking to your Lecturer, you can speak to any other member of staff or the Academic Director.

If you wish to make a formal complaint, you can either put this in writing and give it to Reception addressed to the Academic Director, send an email to the Academic Director, or make a request to speak directly to the Academic Director. The urgency of the issue will be assessed and a time frame for resolving your complaint given to you. We will then report back to you within the agreed time-frame, with a resolution proposal or action.

If you are not satisfied you may put this in writing to the CEO and give it to Reception, send an email to complaints@futureskills.co.nz addressed to the CEO or make a request to speak directly to the CEO.

Assessment of current knowledge

Any previous studies that you have completed which are registered on the NZQA database will be automatically considered towards your current studies. This means that if you have already achieved a unit standard that is part of your course you don’t need to do the assessment again. If you have prior learning or experience that you consider meets the learning outcomes of a component of your course, discuss this with your lecturer.

 

Assessments

You will need to successfully complete all of the assessments, to gain the qualification.  Assessments can be written, oral, practical, group or project based. Sometimes your lecturer will use a class activity as evidence for your assessment. Ashton Warner Academy tries to make the assessment process as simple as possible for you.

Once your assessments have been marked the lecturer will advise you of your result. You have the right to view your marked assessment papers.  All assessment documentation is retained by Ashton Warner Academy.

If you do not successfully achieve in an assessment, you may do a re-assessment.

 

Appeal of assessment results

If you think that your assessment result is unfair, discuss this with your lecturer.  If you cannot reach agreement with your lecturer, you can request for the assessment to be re-marked by a second assessor.  Contact Student Services if you cannot reach agreement with your lecturer, to request a second assessor.

 

Assessment Results and Graduation

After you have achieved a unit standard, the result will be entered into the NZQA database. You can access your own Record of Learning at any time on the NZQA website using your NSN number. Go to http://www.nzqa.govt.nz/login/
Please note that sometimes it can take several weeks for results to show up.

After you successfully complete your qualification, you and your family are invited to attend graduation where you will receive your National Certificate.

After you graduate

Completing your programme at Ashton Warner Academy is going to help you to shape your career. Many of our students will continue studying at a higher level, others are finding employment. Throughout the course, the lecturers will share their knowledge about the industry you have chosen to pursue your career in. Your lecturer and Student Services can provide advice on further training and educational opportunities. Ashton Warner Academy will keep contact with you after you complete your course to provide assistance and confirm that you have been successful in moving onto further study or obtaining employment. Your future success is important to us.

 

Plagiarism

When completing assessments, you must do your own original work. Copying from other students is not allowed. Your lecturer will guide you regarding the conditions for each assessment. This will also be elaborated upon in your course handbook.

 

Disciplinary Procedures

The disciplinary procedures are provided for the protection of students and staff.

Misconduct

If you do not comply with the rules, you will be asked to come to an interview and will be given a written warning notice.  If you have already received 2 written warnings and still do not comply with the rules, you may be dismissed.

Serious Misconduct

If you do not comply with the rules, and you put yourself or others at risk, you may be immediately suspended or immediately dismissed.  If you are aged under 18 your parent or caregiver will be informed and asked to attend a meeting with you at Ashton Warner Academy prior to any dismissal.  The following are considered as serious misconduct:

  • Physical abuse, assault or intimidation of any person
  • Use of abusive, intimidating or threatening language
  • Acts that may cause injury to another person
  • Possession of and/or under the influence of alcohol, drugs, stimulants, chemical substances or any illegal substance;
  • Selling and/or dealing in illegal substances
  • Possession of a weapon
  • Misuse of fire or safety equipment or failure to report a fire
  • Purposeful damage to property of Ashton Warner Academy
  • Unauthorised removal from Ashton Warner Academy campus, or possession of property belonging to Ashton Warner Academy students or staff or any other person.
  • Harassment including sexual harassment and bullying

If you come to campus and are suspected of being drunk, high or stoned you may be sent home, you may be required to have a drugs assessment and counselling by an alcohol and drug service.

Ashton Warner Academy reserves the right to search your personal effects or your motor vehicle, for non-prescribed drugs, stimulants, chemical substances, alcohol and stolen property, on chemical substances, alcohol and stolen property, on reasonable grounds of suspicion.  Failure to allow Ashton Warner Academy to conduct a search shall be treated as serious misconduct. If you are suspected of supplying drugs to other students the police will be called to investigate and you may be dismissed immediately.

You may appeal against any disciplinary action by using the formal complaints process.
